The Basics

Gathering Events ("we", "us", "our") provides an online service that uses artificial intelligence to organize, transform, and display a variety of media from a variety of sources. By using our service, you agree to these terms. If you don't agree, please don't use the service.

This service is for entertainment purposes only. We make no guarantees about the accuracy, quality, or appropriateness of AI-generated content.

Who Can Use This

You must be at least 18 years old to use Gathering Events. By creating an account, you confirm that you're 18 or older and have the legal capacity to enter into this agreement.

Your Account

You're responsible for keeping your account secure and for all activity that happens under your account. If you think someone else is using your account, let us know right away.

Content You Submit

When you submit content to Gathering Events:

  • You keep ownership of your content
  • You give us permission to store, process, display, and distribute your content as needed to provide the service
  • You give us permission to use submitted content, including altered or processed versions, for marketing and promotional purposes
  • You confirm that you have the right to submit this content and that submitting it doesn't violate anyone else's rights

We don't control what people submit. Other users can submit content to events or galleries under your account, and we have no way to screen this content before it's processed. You're responsible for moderating the content in your account.

AI-Generated Content

Our service uses artificial intelligence to organize photos and generate captions. We don't control what the AI produces. AI systems can make mistakes, generate inappropriate content, or produce results that are inaccurate or offensive.

You're responsible for reviewing content (both original and generated) before sharing it or making it available. We provide tools to manage content, and we encourage you to use them.

Acceptable Use

Don't use Gathering Events to:

  • Submit illegal content
  • Harass, threaten, or harm others
  • Violate anyone's privacy or intellectual property rights
  • Attempt to hack, disrupt, or abuse our systems
  • Use the service for any illegal purpose

We reserve the right to remove content and terminate accounts that violate these terms, at our sole discretion and without notice.

Payments and Refunds

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service.

Refunds are handled on a case-by-case basis at our discretion.

Service Availability

We try to keep Gathering Events running smoothly, but we can't promise 100% uptime. The service may be unavailable due to maintenance, technical issues, or circumstances beyond our control. We may also modify or discontinue features at any time.

Limitation of Liability

To the maximum extent permitted by law, Gathering Events is provided "as is" without warranties of any kind. We're not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to defend and hold us harmless from any claims, damages, or expenses (including legal fees) arising from: your use of the service; content you submit or enable others to submit or the transformation of that content; others' use of the service; or any violation of these terms by you or anyone else.

Disputes and Arbitration

These terms are governed by the laws of California, USA.

You agree that any dispute arising from these terms or your use of the service, including enabling others to use the service, will be resolved through binding arbitration, rather than in court, except that either party may bring claims in small claims court if eligible. Arbitration will be conducted by JAMS under its Streamlined Arbitration Rules in California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we'll post a notice on the service. Your continued use after changes take effect means you accept the new terms.
